Litigation Staff Attorney

Eviction Defense Collaborative is seeking an enthusiastic new member of our litigation team. EDC provides a vital service representing tenants sued in unlawful detainer. EDC is on the frontline of eviction defense in San Francisco, assisting over 95% of all unlawful detainer cases in the City. We fight for our clients to keep their homes. The work is fast-paced and demanding, but very rewarding. You will work with an experienced team representing clients throughout their case, beginning with pre-trial motions, through discovery, and at trial.

THE ORGANIZATION

The Eviction Defense Collaborative (EDC) provides legal assistance, advocacy and representation to predominately low-income and indigent tenants in San Francisco who are being evicted. We assist by educating tenants about the legal process, advising them of their options, drafting responsive their legal documents, providing referrals to assist them in fighting their evictions, negotiating legal settlements and representing them at trial. The EDC also administers one-time rental assistance grants and loans through our RADCo program to help tenants who are behind in their rent to pay the rent and stay in their homes. The work at the EDC is made possible by a dedicated staff and many volunteers from local schools and the community. The work environment at the EDC is collegial, rather than having a rigid hierarchy of job positions, and we work as a team to assist the tenants who seek our help. PRIMARY RESPONSIBILITIES

Represent tenants full scope in all aspects of unlawful detainer actions

Draft and argue noticed motions, ex-parte applications, and trial motions in Housing Court

Manage an active case load as determined by litigation supervising attorney, including taking unsettled cases at settlement conference for trial call

Represent tenants limited scope at Mandatory Settlement Conference

Review legal documents with tenants; instruct them on filing these documents and how to prepare for hearings and settlement conferences

Work with attorneys and other EDC staff to train and supervise volunteers and interns

Evaluate and screen cases for appropriate referrals for direct representation by EDC and other legal services organizations

Provide support for volunteer attorneys and attorneys at other legal services organizations representing tenants

Encourage positive morale in your team and agency

Perform other duties as assigned

QUALIFICATIONS

California Bar Membership.

Demonstrated commitment to social justice and an interest in assisting diverse, low-income communities.

Be well-organized, highly motivated, and creative.

Able to work independently and in a team-oriented environment.

Excellent written and oral communication skills and computer literate. There is significant computer use.

Able to work on several projects simultaneously, and handle a high volume of activity.

COMPENSATION: Competitive Non-Profit Salary (DOE)
